The content of the “Mortgage Choice Act” (solves 3 Percent Cap, etc.) is part of the Financial Services and General Government bill (“FSGG”) under active consideration right now in Congress. We’ll need it to be added in conference committee, as only one chamber actually included it, but that seems doable. There is a “TRID fix” that also could make it into final legislation if the entire effort is successful. We have thought we’ve had promising windows in the past, but they never succeeded. This environment seems the most promising, so members of our industry coalition are more optimistic than ever. That said, the same group feels it may be now or never … if it doesn’t get through this fall, these fixes might not get done in future months/years. Stay tuned for a “call to action” if we get it to the point where hearing from you will help your elected officials vote “yes.” Current weather events likely will be top of mind later this fall with the National Flood Insurance Program (“NFIP”) comes up for renewal before long. A final fix on this is unlikely, so expect to hear about yet one expiration after another in the coming years.
